WebOpine Copyright Policy

1. Introduction
WebOpine (“we”, “us”, “our”) respects the intellectual property rights of others and expects our users to do the same. This policy is in accordance with the Copyright Act, 1957, of India, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
This policy outlines the procedure for copyright owners to notify us of any alleged copyright infringement on the WebOpine platform and for users to respond to such notices. By using the WebOpine platform, you agree to abide by this Copyright Policy and our Terms and Conditions.
2. Prohibition of Copyright Infringement
You may not post, upload, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. This includes, but is not limited to:
Text from other websites, books, articles, or other reviews.
Photographs, videos, or images taken by someone else.
Company logos or brand materials used without authorization.
It is our policy to terminate the user accounts of repeat infringers in appropriate circumstances.
3. Procedure for Reporting Copyright Infringement
If you are a copyright owner or an agent thereof and believe that any content hosted on WebOpine infringes upon your copyright, you may submit a formal notification of claimed infringement.
To be effective, your notification must be a written communication sent to our Designated Grievance Officer and must include substantially the following:
Identification of the copyrighted work that you claim has been infringed. Please provide sufficient detail, such as a link to the original work or a detailed description.
Identification of the infringing material on the WebOpine platform that you are requesting be removed. Please provide the specific URL(s) where the material is located. This is essential for us to locate and act upon the content.
Your contact information, including your full name, physical address, telephone number, and email address.
A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Your physical or electronic signature.

Upon receipt of a valid and complete notice, WebOpine will act expeditiously to remove or disable access to the allegedly infringing material and will notify the user who posted the content.
4. Counter-Notification Procedure
If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may send a counter-notification to our Designated Grievance Officer.
To be effective, your counter-notification must be a written communication and include substantially the following:
Identification of the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or disabled.
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
Your contact information, including your full name, physical address, telephone number, and email address.
A statement that you consent to the jurisdiction of the court located in the judicial district where your address is located, or if your address is outside of India, for the judicial district in which WebOpine is located (i.e., the competent courts in Uttar Pradesh, India), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.
Your physical or electronic signature.
Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party. We will inform them that we may replace the removed content or cease disabling it in 10-14 business days unless the original complaining party files an action seeking a court order against the content provider.

Please be aware that making false claims in an infringement notice or counter-notification may lead to legal consequences. You may be liable for damages, including costs and attorneys' fees, under applicable law.
